Florida Statute 948.04 Compared With 948.05
The two sections are often mentioned together and are easy to conflate. In broad terms one is about the length of supervision and the other about the court's authority over the person serving it.
Marked for legal review — read the table as orientation only
The comparison below is a general characterisation of what each section deals with. It is not statutory text, it simplifies, and it has not been checked against the official provisions by a Florida attorney. Which section governs your case is a legal question that depends on your sentence and the law in effect when it was imposed.
Side by side
Both sections sit in Chapter 948 and both can come up when supervision is in question. In general terms:
| § 948.04 | § 948.05 | |
|---|---|---|
| Broad subject | The period of probation and the probationer's duties during it | The court's continuing authority in relation to a person under supervision |
| Question it speaks to | How long does supervision run? | What may the court do about the person serving it? |
| Relevance to ending supervision early | Usually the starting point, because the term is what a motion asks to shorten | Often cited for the court's power to discharge someone from further supervision |
| Nature of what it provides | Framework for the term itself | Authority exercised at the court's discretion |
| Creates an entitlement? | No | No |
Which one applies to your case
This is not a question that can be answered from a table. It depends on the sentence imposed, whether the supervision is probation or community control, the offense of conviction, and the law in effect at sentencing.
In practice a motion may reference both — one for the term, one for the authority — and which framing is used is a drafting decision made from the case file.
What does not differ
Whichever provision a request is brought under, the same things decide it: how much of the term has been served, whether the conditions are complete, whether restitution and costs are paid, whether there have been violations, and what position the State and the supervising officer take.
Neither section converts a strong record into an entitlement, and neither rescues a weak one. See eligibility and reasons for denial.
Read the sections themselves
The individual pages for § 948.04 and § 948.05 each carry a link to the official text and a last-reviewed date. Where a summary here and the official provision appear to disagree, the official provision is right.
